Partner Program Data: Affiliate program records (commissions, payouts, tax IDs where applicable) and franchise/reseller/white-label program application and verification data are collected when you enroll or interact with those programs.
Sensitive Data: We do not knowingly collect sensitive biometric data or store full financial card details directly. If sensitive data is provided via contact forms unintentionally, contact us to request removal.
2. How We Use Information
We process personal information for the following purposes: to provide and improve Services (including SaaS platforms), to communicate and onboard customers, to run marketing and automation campaigns (with consent where required), for billing and subscription management, to track affiliate conversions and settle commissions, to verify eligibility for franchise/reseller/white-label offerings, for fraud prevention, and to comply with legal and regulatory obligations. We do not sell personal information.
3. Legal Grounds of Processing (GDPR)

8. Email & SMS Marketing (CAN-SPAM)
We comply with CAN-SPAM and comparable laws: commercial emails clearly identify the sender, include a valid contact address, and contain an unsubscribe mechanism. SMS and other direct marketing channels include opt-out instructions. We process unsubscribe requests promptly.
9. CCPA — California Consumer Rights
If you are a California resident, you have rights under the CCPA including the right to request information on categories of personal data collected, the right to request deletion, the right to opt-out of the sale of personal data (we do not sell personal data), and the right to non-discrimination for exercising privacy rights. Payment processing is handled by PCI-compliant third-party processors. We do not store full card numbers on our systems. Billing and invoice records are retained as required for accounting and legal obligations.

Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of the website, products and services offered by CJDMS (CJ Digital Marketing Services) ("CJDMS", "we", "our", "us"). By accessing or using our website, subscribing to our SaaS offerings, purchasing services, joining affiliate/reseller/franchise programs, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Definitions & Scope
"Services" means any SaaS platform, digital marketing, automation, consultancy, affiliate offers, franchise/reseller programs, white-label services, training, or other products supplied by CJDMS. "User/Client/Customer" refers to any individual or legal entity using CJDMS services. These Terms apply to all Services unless superseded by a separate written agreement (e.g., Master Service Agreement, Franchise Agreement).
2. Eligibility & Account Registration
Who May Use: To use our services you must be at least 18 years old and legally capable of entering into a contract. Business entities must authorize a representative with authority to bind the entity.
Account Responsibility: Account holders are responsible for accurate registration information and for maintaining confidentiality of credentials. You are responsible for all activity under your account.
3. Services, Subscriptions & Deliverables
SaaS & Subscriptions: SaaS products are licensed, not sold. Subscriptions grant a non-exclusive, non-transferable license to use the software according to the chosen plan. Features, quotas, and support terms depend on the plan selected.
Managed Services & Campaigns: Digital marketing campaigns, automation setups, creative work, and managed services are delivered according to project scopes. Delivery timelines are estimates and depend on client cooperation, third-party approvals, and ad platform processes.
Affiliate / Reseller / White-Label Programs: Participation requires a separate program agreement. Commissions, eligibility, tracking rules, payout schedules, and compliance requirements are governed by those agreements and the RWF Policy.
Franchise & Licensing: Franchise or territorial rights are provided under distinct Franchise Agreements. Franchisees must comply with onboarding, reporting, royalties, brand guidelines, and performance KPIs as specified in the applicable agreement.
4. Orders, Pricing & Payment Terms
Fees & Billing: All fees for services, subscriptions, setup, training, franchise license, renewal and any applicable taxes are outlined in invoices and order confirmations. Prices may be updated; existing paid periods are honored.
Payment Methods: We accept payments via approved third-party processors. Payment details are handled by processors; CJDMS does not store full card numbers.
Late Payments & Suspensions: Late payments may incur interest or penalties. Non-payment may result in suspension or termination of services until accounts are brought current.
5. Refunds, Cancellations & Trials
Refund and cancellation rules are provided in our Refund & Cancellation Policy. Generally, due to digital delivery, fees for SaaS subscriptions, digital products, franchises, and services are non-refundable except in specific, documented cases (e.g., duplicate charges, proven processor error). Free trials convert to paid plans if not canceled before the trial expiry.
6. Intellectual Property
Ownership: All intellectual property rights in CJDMS platforms, software, documentation, templates, processes, methodologies, branding, and content remain the exclusive property of CJDMS or its licensors.
License Restrictions: Clients and partners receive a limited, revocable license to use deliverables for internal business purposes unless a separate written license grants broader rights. You must not copy, modify, distribute, reverse-engineer, sublicense, or create derivative works except as expressly permitted.
7. Data, Privacy & Security
Data processing is governed by our Privacy Policy and DPSC Statement. Clients are responsible for lawful collection of end-user data and must obtain consents required by applicable laws (GDPR, CCPA, DPDP). Security measures and data handling practices are outlined in our Data Processing & Security Compliance Statement.
8. Service Levels & Support
SaaS uptime targets, support response times, maintenance windows, and service credits (where applicable) are defined in our Service Level Agreement (SLA). Support availability varies by plan; premium or enterprise tiers may receive elevated SLAs and dedicated support channels.
9. Third-Party Tools & Integrations
CJDMS may integrate third-party services (ad platforms, analytics, payment gateways, CRMs). Those services are subject to their own terms and separate privacy policies. CJDMS is not liable for third-party outages, policy changes, or termination.
10. Warranties & Disclaimers
To the fullest extent permitted by law, CJDMS provides services "as-is" and disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific results (traffic, rankings, revenue) from marketing activities.
11. Limitation of Liability
Except where prohibited by law, CJDMS's total aggregate liability to you for any claim arising out of these Terms will not exceed the total fees paid by you to CJDMS in the three (3) months preceding the claim. CJDMS is not liable for indirect, incidental, consequential, or punitive damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless CJDMS and its officers, directors and employees from any claim, loss, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Services, breach of these Terms, or violation of applicable law.
13. Confidentiality
Each party shall keep confidential all non-public information disclosed by the other party and shall not use such information except as necessary to perform the Services. Confidentiality obligations survive termination.
14. Term, Suspension & Termination
Term: These Terms commence on the Effective Date and continue until terminated in accordance with the agreement governing the specific Services.
Suspension & Termination: CJDMS may suspend or terminate access in case of breach, non-payment, security risks, illegal activity, or at its discretion for material reasons. Upon termination, outstanding fees remain payable and any licensed access will cease. Post-termination data handling will follow the Data Retention & Deletion rules in the Privacy Policy.
15. Reseller, White-Label & Franchise Terms
Reseller, White-Label and Franchise arrangements are governed by separate agreements and the RWF Policy and Franchise Master Agreement. Partners must adhere to brand guidelines, pricing rules, reporting, and compliance obligations. CJDMS reserves the right to audit partner compliance and revoke rights for breaches.
16. Marketing & Affiliate Conduct
Affiliates and partners must not engage in misleading marketing, spam, or unethical practices. Affiliate payouts are conditional on verification of legitimate activity. Abuse, fraud, or violation of ad platform policies may lead to withholding of commissions and termination.
17. Dispute Resolution
In the event of dispute, parties will attempt good-faith negotiation and escalation. Where unresolved, disputes will be subject to the exclusive jurisdiction of courts in Bhuj (Kachchh), Gujarat, India, and governed by the laws of India. Parties may, by mutual agreement, choose mediation or arbitration prior to court action.
18. Changes to Terms
CJDMS may update these Terms from time to time. Material changes will be posted on this page with a revised effective date and, where required by law, notified to account holders. Continued use after changes indicates acceptance where permitted.

Notices should be sent to the registered contact addresses set out in account profiles or to the contact details below. Notices are effective upon receipt.

Refund & Cancellation Policy
This policy governs refunds, cancellations, chargebacks and billing disputes for all CJDMS products and services, including SaaS subscriptions, automation platforms, digital products, managed marketing services, training, franchise/reseller/white-label agreements and related deliverables. CJDMS operates a generally strict no-refund policy with specific exceptions noted below.
1. Digital Products, SaaS & Licenses
Purchases of digital products, software licenses, plugins, downloadable assets, or SaaS subscriptions are final and non-refundable once access credentials are issued, the product is downloaded, or the subscription/service is activated. Trial periods must be cancelled before expiry to avoid paid conversion. Customers should verify plan features before purchasing.
Where a subscription is billed and access is provided immediately, no refunds will be issued for partial usage of the subscription period unless otherwise stated in a separate written agreement.
2. Managed Services, Campaigns & Project Work
Services that require human work — such as strategy development, campaign setup, ad management, content creation, automation configuration, technical integration, and onboarding — are non-refundable once CJDMS or its authorized partners commence work. "Commence work" encompasses acceptance of project scope, resource allocation, development initiation, third-party orders, or any active execution steps.
If a customer cancels a service before work has commenced and no third-party non-refundable costs have been incurred, CJDMS may, at its discretion, issue a refund or account credit subject to administrative fees.
3. Franchise, Reseller & White-Label Fees
Franchise fees, territory deposits, reseller or white-label licensing fees, onboarding charges, and any payments associated with granting partner rights are non-refundable once approval, credentials, access or proprietary materials are issued. Partners should review Franchise Master Agreements, Partner Agreements, and RWF Policy terms for cancellation and transfer specifics.
Any refunds for partner programs are subject to the terms of the executed partner agreement and may include deductions for administrative, training, or onboarding costs.
4. Training, Courses & Consultations
Fees for live training sessions, recorded courses, workshops, coaching, or consulting appointments are non-refundable once access is provided or the session date/time has passed. Rescheduling may be available based on availability. Group discounts or bundled packages follow their own refund rules as stated at purchase.
5. Affiliate Commissions, Credits & Incentives
Affiliate commissions, referral payouts, promotional credits, and similar incentives are final once approved and issued. In suspected fraud, policy abuse, invalid traffic, or affiliate terms violation cases, CJDMS reserves the right to withhold, claw back, or offset commissions and credits. Affiliates agree to terms within their affiliate agreement governing dispute resolution.
6. Duplicate Charges, Payment Errors & Administrative Exceptions
While refunds are generally not provided, CJDMS will review and may refund validated duplicate charges, processing errors, or clearly documented gateway mistakes. Customers must notify CJDMS within 7 days of the transaction with transaction IDs, proof of payment, and supporting documentation. Investigation findings will be communicated within three business days.
Approved administrative refunds will be returned to the original payment method where possible. In some cases, CJDMS may, at its discretion, issue account credit instead of a reversal to the payment method.
7. Subscription Cancellations & Renewal
Subscribers may cancel upcoming renewals at any time via account settings or by contacting support. Cancellation prevents future charges but does not entitle the customer to a refund for the current or prior billing cycles. Access typically remains available through the end of the paid period. Prorated credits are handled only if explicitly stated in a signed agreement.
8. Chargebacks & Disputes
Upon chargeback initiation, CJDMS will provide evidence to the acquiring bank and card network demonstrating service delivery, access logs, communications, and other relevant records. If resolved in CJDMS's favor, the customer will be liable for the transaction amount and any chargeback fees or penalties charged by the payment processor. Repeated chargebacks or fraudulent disputes may result in service termination and legal action.
9. Refund Review & Processing Procedure
Refund exception requests should be submitted using the contact details below, including order ID, registered email, transaction ID, purchase date, and detailed reason. CJDMS will acknowledge receipt within three business days and commence investigation, potentially requiring additional documentation.
Where refunds are approved, CJDMS will attempt to process the refund to the original payment method. Refund processing timelines vary by provider; approved refunds are typically completed within 7–14 business days, though external processor delays are possible. Alternatively, account credit or other remedies may be offered at CJDMS's discretion.
10. Taxes, Fees & Currency
Prices, fees and refunds may be subject to applicable taxes (GST/VAT) or other regulatory levies. Customers bear responsibility for locally-required taxes. Refunds will reflect tax treatment as legally required. Currency conversion fees and bank processing charges may be deducted by payment processors and remain outside CJDMS's control.
11. Special Circumstances
In limited circumstances where service delivery is materially impacted by prolonged outages, platform failures, or force majeure events, CJDMS may, at its discretion, provide pro-rated service credits or other remedies rather than cash refunds.
12. Governing Law & Jurisdiction
This Policy is governed by the laws of India. Any disputes concerning refunds, billing, or this Policy shall be subject to the exclusive jurisdiction of the courts in Bhuj (Kachchh), Gujarat, India, unless otherwise specified in a written contract between the parties.

5. Affiliate, Advertising & Sponsored Content
Some links, promotions, reviews, or recommendations presented by CJDMS may generate commissions or commercial partnerships. We may receive referral income or affiliate earnings from qualifying actions. We only promote tools or solutions that align with our operational standards.

Service Level Agreement (SLA)
This Service Level Agreement ("SLA") outlines the level of service and support that CJDMS (CJ Digital Marketing Services) ("CJDMS", "we", "us", "our") will provide to customers ("Client", "User", "You") who subscribe to or utilize our Marketing Automation Tools & SaaS Platforms; CRM Systems, Landing Pages & Hosting Services; Managed Business Solutions & Support Services; and Digital Marketing Execution Services. This SLA forms an integral part of the Terms & Conditions and Master Service Agreement (if any).
1. Service Availability & Uptime Guarantee (SaaS Only)
We target 99.5% uptime availability for our hosted solutions each calendar month, excluding scheduled maintenance, emergency security updates, force majeure events (beyond reasonable control), and downtime caused by Client systems, internet provider, or third-party tools. If uptime drops below 99.5%, service credits may apply (see Section 7).

Support business hours: 10:00 AM – 7:00 PM IST (Monday–Saturday). Priority support is available for eligible enterprise plans.
3. Maintenance Policy
Scheduled Maintenance: Performed during low-usage hours; notice will be provided at least 24 hours in advance where possible.
Emergency Maintenance: Conducted as needed to protect security, stability, or integrity, and may occur without prior notice in urgent conditions.
4. Client Responsibilities
To maintain service performance, the client agrees to provide accurate and updated business data, ensure proper device and internet connectivity, not misuse the system or cause excessive load, and maintain compliance with all policies and laws. Failure to comply may void SLA guarantees.
5. Third-Party Dependencies
Our services may rely on hosting providers, payment gateways, email/SMS delivery vendors, and ad platforms & CRMs. Interruptions or failures by these external vendors are excluded from SLA credits.
6. Data Backup & Security
Regular data backups are performed in accordance with internal security policies. There is no guarantee of complete restoration in case of client-side deletion or attack. Additional backup solutions are available for enterprise plans.

Conditions: credits must be requested within 7 business days of the incident; credits apply only to future invoices (no cash refunds); credits are not applicable if downtime was caused by the Client or third-party failures.
8. Exclusions
This SLA does not apply to beta or trial features; client errors or unauthorized changes; force majeure events; affiliate or resold platforms not owned by CJDMS; or delays in client approvals affecting marketing services.
9. Modifications to SLA
CJDMS may update or revise this SLA periodically. Revisions will be posted on this page and become effective immediately.
10. Governing Law & Jurisdiction
This SLA is governed by the laws of India. Legal matters will fall under the jurisdiction of Bhuj (Kachchh), Gujarat, India.

Implemented safeguards include SSL/TLS encryption, multi-factor authentication, firewall monitoring, data segmentation, encrypted backups, and role-based access management. Systems undergo periodic security reviews.
4. Data Storage & Retention
Data is stored on secure servers in compliant data centers. Retention is limited to service delivery, business operations, and legal obligations. Data may be anonymized for analytics.
5. Data Sharing & Sub-processors
We share data on a limited basis with cloud providers, analytics tools, payment processors, affiliate systems, and communication platforms. All vendors comply with equivalent security obligations. We do not sell personal information.
6. Cross-Border Data Transfers
Transfers use standard contractual clauses, adequate protection measures, and lawful agreements, adhering to GDPR frameworks.
7. Data Breach Notification Policy
Upon a breach, we conduct a prompt investigation, notify users/authorities as required, and take immediate corrective action. Notification timelines comply with governing laws.
8. Customer Responsibilities
Clients must maintain secure credentials, ensure authorized access only, and use services lawfully. Client-side security mismanagement falls outside SLA coverage.

Any changes to this Statement will be posted publicly and become effective immediately.

RWF Policy
This Resell, White-Label & Franchise (RWF) Policy governs all authorized Resellers, White-Label Partners, Franchise Partners, and Distribution Partners (collectively, "Partners", "You"). It forms part of the Master Service Agreement (MSA) and Terms & Conditions.
1. Partner Authorization Levels
Authorization is granted based on Partner Program enrollment and written approval. Resellers may sell under the CJDMS brand only, with full pricing rights; White-Label partners may use their own branding with full pricing rights and mandatory training; Franchise Partners operate under mixed branding per territory with regulated pricing, exclusive territory rights, and mandatory training with full support responsibility. Unauthorized representation is strictly prohibited.
2. Franchise Rights & Obligations
Franchise Partners are granted exclusive or semi-exclusive territorial rights; access to the business ecosystem, operational playbooks & marketing assets; lead allocation (where applicable); local recruitment and client management rights; and optional use of "Powered by CJDMS" branding.
Franchise Fees (if applicable): a one-time Franchise License Fee, a monthly/annual royalty fee, and performance-based revenue share. Partners must follow local compliance laws, CJDMS brand and operational playbooks, and ethical marketing guidelines. No sublicensing or territory reselling is permitted without CJDMS approval.
3. Intellectual Property (IP) Protection
All tools, software, processes, learning modules, and branding assets are owned solely by CJDMS. Usage is granted under a limited, revocable license. Reverse engineering, copying, or unauthorized duplication is strictly forbidden.
4. Sales, Pricing & Payment Rules
Pricing must follow published MRPs for franchise territories (if defined); partners may set pricing independently for local markets where allowed. GST/VAT/local taxes remain the partner's responsibility. Non-payment can revoke partnership rights.
5. Customer Relationship Ownership
Direct partner-acquired clients are owned by the Partner (with CJDMS oversight); HQ-acquired leads assigned to a Partner are shared; global SaaS subscription clients are owned by CJDMS. Franchise partners must ensure quality delivery, handle escalations collaboratively with CJDMS, and adhere to SLA commitments.
6. Data Protection & Compliance
All partners must comply with GDPR, CCPA, the India DPDP Act 2023, and local advertising & privacy laws. Any misuse of client data may result in immediate termination without refund.
7. Brand Usage Guidelines
Only approved marketing assets may be used. White-label partners must remove CJDMS branding unless permitted. Franchise partners must follow brand consistency rules — no fake income guarantees or misleading claims. Marketing audits may be conducted at any time.
8. Support & Service Responsibilities
CJDMS handles SaaS hosting, system uptime, and first-level issue escalation support. Partners are responsible for local onboarding & support and client billing, with CJDMS support optional in those areas.
9. Termination Clause
A partnership may be suspended or terminated for compliance violations, non-payment beyond grace period, brand misuse or reputation damage, or unauthorized sublicensing or region violations. Upon termination, access is revoked, branding must be immediately removed, and data must be securely transferred to CJDMS or the client. No refunds are issued for franchise/partner fees.
10. Liability Limitation
CJDMS is not responsible for a partner's operational issues, third-party vendor failures, or loss of business or profits. Liability is capped at fees paid during the last 3 months.
11. Policy Updates & Governing Law
This policy may be updated at any time. Disputes fall under the exclusive jurisdiction of Bhuj (Kachchh), Gujarat, India.
